[Editor's note: University of North Dakota, until recently has hidden behind the antiquated law of sovereign immunity. This means that no matter how horrible it was, as a state agency they were immune from lawsuits. . .Although this case is a bit old, it shows a repeated history of misconduct at UND, pervasive if you will.]
IMMUNITY APPEAL REACHES N.D. COURT
The North Dakota Supreme Court will hear an appeal of a Grand Forks district judges decision to grant UND immunity in a graduate student's lawsuit accusing a former professor of sexual harassment and assault.
Mary Leadbetter accused UND physiology professor Richard Rose, 50, of forcing her to perform oral sex in a New Orleans hotel room in March 1989. They were there to attend a conference. Her suit requested $50,000 actual damages and $1 million in punitive damages and named both UND and Rose.
