The University of North Dakota (UND) is trying to get rid of a victim in order to avoid facing the unpleasant task of dealing with the assailant. This victim is not going to remain buried.
PUBLIC HEARING
They railroaded me out of UND in a hearing that I opened to the public. Because of the open hearing, everything I am about to say is public record. Further, in the hearing I was found not guilty of violating section 2.2H of the Student Code of Life which is falsifying information. DR. JON LINDGREN, the ex-Mayor of Fargo was my advisor. Dr. Lindgren is also the North Dakota representative of the A.A.U.P. (American Association of University Professors).
Although Dr. Lindgren pointed out that the UND judicial system was clearly illegal by AAUP standards, and although the Student Code of Life has since been reviewed, unfortunately, they have changed nothing but the names of the positions of the judiciary members.
PUNISHMENT FOR WHISTLE-BLOWER
I was indefinitely suspended from the University of North Dakota when I reported a teacher's misconduct to the Affirmative Action Officer Sally Page As soon as I made the report, the Affirmative Action Officer went directly to the teacher and to the Dean of Students Lillian Elsinga, where they began making a case against me for making the report.

My Physics Professor John Lester Wagner and I had many long phone conversations. We also E-mailed each other back and forth. In the beginning I liked him and told him it would be fine for him to phone me at night at home so we could carry on our conversations from the day. These conversations soon became a bit too friendly though, as Professor Wagner began to call me from his office with the ‘door closed' and to masturbate to my voice. From him I learned that he had only had "natural" sex with women twice in his early/mid twenties. As John was now almost 40, it was probably almost fifteen years since he had been active. And what was "natural" I wondered? He asked if I would have sex with him to teach him. There is NO POLICY at UND that says that a Professor may not engage in Sex with a Student He told me that because I was aggressive, he would always think of me as a ‘maybe'. I E-mailed him back my refusal, telling him that I liked my men like I liked my espresso hot, sweet and Black. I jokingly wrote that I would keep him in mind for semen however if he ever won the Nobel prize! Professor Wagner caught me in lab that day and asked if all of my boyfriends had been Black. He asked if my current boyfriend was Black and said that he would be interested in 'watching'. He got really exited and asked if my boyfriend was 'bi' (bisexual) at all. I just kept responding "no, no, no".
PEDOPHILIA
I did not report this professor until after I had gotten my grade. The masturbating did not really bother me much as the teacher was fairly "quick". It was the fact that in revealing his fantasies, he talked a lot about liking kids. Professor Wagner said that he liked children between the ages of eight and thirteen. He said that once they reached puberty they were ruined for him. He made a point of inviting all parents to bring their children to class if they needed. Then he pointed out certain children he liked to me. He told me that his brother was a convicted child sex offender and was only allowed supervised visitation with his children. Professor Wagner was very angry about that. He said that his brother's wife had gotten his brother into trouble. I finally reacted when he told me that he was targeting kids at his Methodist Church and that he was a Boy Scout leader in the community. Then I got the idea that more might be going on than mere fantasy. I made the initial report to Dick Grosz , the Director of Counseling. I asked Dr. Grosz if he thought it was mere fantasy, or if he thought Professor Wagner was actually targeting children in the Grand Forks Community? Dr Grosz referred me to Sally Page. In the end, both stood up for the suspected pedophile and railed against me for reporting him. They said that it was none of my business as these supposed activities were off-campus
RETALIATION/COVER-UP
Various University officials investigated for three months Physics Professor John Lester Wagner's pre-emptive defense accusations against me that I had harassed and stalked him by email while ignoring my side of the situation even though my version was corroborated by physical evidence, including, but not limited to records establishing the lengthy telephone conversations he initiated with me. In the hearing, Professor Wagner readily admitted phoning me at night from his home on as many as ten occasions with many calls lasting up to an hour and a half. He said he was just being "polite." Professor Wagner also stated that I was such a bother that he "gave" me a grade of ‘B' although I deserved a ‘D' to not be bothered with me. (Supporting Evidence: HERALD Article ) How many UND professors phone students from their homes at night to be polite, and from their offices after hours with the "door closed' and change their grades accordingly? They suspended me and they did not even reprimand Wagner. I believe that the disparity in the hearing was sexually motivated and based and is consistent with a pattern of such conduct in earlier cases at UND. Professor Wagner retaliated against me for my declining to accept his offer to engage in sexual intercourse and used the authority of his position to harm me for my declining his wishes.
KANGAROO COURT
They pitted me against Jerry Bulisco, a trained professional in a hearing that lasted twenty hours. On behalf of the University, the Dean of Students office spent a small fortune (the in-house cost probably exceeded $100,000,) gathering 750 pages of mostly useless evidence against me over a three-month period. Dr. Lindgren and I had two weeks and fifty bucks between us. I was under a directive that I must not speak about my charges and UND did not allow me to have an attorney. If I did not obey the UND directive, I was to be suspended immediately and evicted from student housing with my young children within three days. It is hard to collect witnesses and evidence on your behalf when they do not allow you to contact anyone or speak. Among the disruptions cited were my asking too many questions after class, coming into class late twice, the reporting of a suicidal Graduate teaching Assistant-GTA CHRIS MILFORD (did I disrupt his life or his death?), challenging the UND Music department and ex-Chair John Miller for refusing to admit or test older than average students, and the removal of Junior High School sized chairs in certain classes and Tom Rand's reception area, where no one medium or large could comfortably squeeze in.

Although everything I said was found to be true at the hearing I was found guilty. This was because the University presented a Century Code to the Committee which is tailored toward abused women. Dr. Wagner took the position of an abused woman and said that although there was no evidence of stalking, he nevertheless "felt" stalked. As the committee that judged me had no formal legal training and were misinformed as to the flavor of that particular law, they voted improperly. Later, when I spoke to the State Attorney, he said that this section of the Century Code was never used because it was not clear enough for any court.
The acts of the UND officials appear to have been motivated by the desire to get rid of a whistle-blower a "troublemaker" according to UND, by distorting the professor's misconduct over a failed would be sexual relationship into a harassment and stalking case against the unwilling party. The University Affirmative Action Officer, Sally Page, serves as a spy to denounce for the purposes of retaliation by University officials, those who make claims of discrimination and also serves to cover-up the occurrence of such prevalent discrimination in a State and especially a University where there is no Equal Opportunities Commission, and which appears to live in the 1950's.
BEWARE
In ending, I have learned that it is not safe to make reports to UND Officials. They will blow your confidentiality and will consider you the problem. I had 11 credits to go and they said I could finish them there, but I transferred out and am finishing my degree elsewhere. Looking at a degree on my wall that came from an institution like UND would make me want to throw up. The question that still remains is "is this the reputation that the State of North Dakota and the University of North Dakota wish to project to the public who pay their salaries?"
